“Can I still own a firearm if I become a medical cannabis cardholder?”
This is a reasonable concern — and the answer depends on the difference between state and federal law.
Kentucky law does not prohibit medical cannabis cardholders from possessing or owning firearms. Individuals who are otherwise eligible to own a firearm under state law are not disqualified solely based on their status as a medical cannabis patient.
The state’s medical cannabis program and its firearms licensing systems are not linked, and applying for a medical card does not require you to forfeit any firearm or permit.
Under federal law, cannabis remains a Schedule I controlled substance. Federal regulations prohibit firearm possession by anyone considered an “unlawful user” of a controlled substance — which includes cannabis, even in states where it’s legal for medical use.
When purchasing a firearm through a licensed dealer, you’ll be asked to complete ATF Form 4473, which includes a question about marijuana use. Federal law enforcement agencies apply this standard, regardless of state legalization.
We encourage all patients to make informed decisions and consider both state and federal law when it comes to firearm ownership and cannabis use.
