Is Marijuana legal in Kentucky?

Only medical marijuana is legal for qualified patients.

As of 2025, medical marijuana is legal in Kentucky for patients who meet specific qualifications and are certified by licensed healthcare providers. Recreational (non-medical) use of marijuana remains illegal in the state.

Program goes into effect; licensed patients may begin accessing medical cannabis.

Step 1: Confirm You Have a Qualifying Medical Condition

To be eligible for a medical marijuana card in Kentucky, you must:

  • Be a Kentucky resident with a valid state-issued ID
  • Be 18 years or older
  • Have a qualifying medical condition such as:

Posttraumatic Stress Disorder

Nausea and Vomiting

What’s Allowed:

  • Medical marijuana in non-smokable forms (e.g., capsules, tinctures, oils, edibles).

  • Use by patients with qualifying conditions and valid certification.

  • Purchase only from state-licensed dispensaries.

What’s NOT Allowed:

  • Smoking marijuana (combustion) or home cultivation.

  • Recreational use by non-registered individuals.

  • Purchasing marijuana outside of licensed dispensaries.

Even if you have a qualifying condition, you must be certified and registered in the state program to legally possess or use medical marijuana in Kentucky.

Step 2: Get a Doctor’s Recommendation

  • The provider will review your medical history and confirm your qualifying condition
  • If eligible, you’ll receive a written certification (also called a recommendation)

Step 3: Apply Through the State Portal

  • Visit the Kentucky Medical Cannabis Program website: Click here
  • Submit Your doctor's certification, Proof of residency (e.g., driver’s license), and Application fee (if applicable)
  • Wait for state approval and your official card (digital or physical)
